Gay barman in “rape lie”
A gay barman is being accused of perverting the course of justice after telling police he had been raped.
Daniel Schwan, 29, an employee of the Chicago Rock Café in Hertfordshire, is on trial at a Cheshunt court for alleging he was attacked in a railway station car park.
British Transport Police had originally investigated rape claims but later charged him with perverting the course of justice and dropped claims against 26 year old Jeffrey Slominski.
The jury heard that Mr Schwan became upset during an evening out and that he felt there was someone outside who wanted to “get him.” His landlord reported the rape allegation to police at 2.43am.
He claims that Mr Slominski “came up behind me and pushed me against the railings and did what he wanted to do. I was scared: I froze. I didn’t want to scream in case he did something else. Afterwards I just felt dirty. I just ran home.”
The prosecution said Mr Slominski had confided in Mr Schwan about coming out and sent the defendant sexual text messages.
Defence barrister Roger Carne claimed the texts indicated he had wanted sex and “cornered” Mr Schwan in the bar, he said suggested Mr Slominski returned to “have another go”.
There was no forensic evidence to support or refute Mr Schwan’s claims.
Mr Schwan insisted to police he was telling the truth. “If I was lying, I wouldn’t have phoned you and taken it this far. What would I get out of it?”
